Abstract

Sarl Louis Feraud International v. Viewfinder Inc., 489 F.3d 474 (2d Cir. 2007) confirms a general theme at the intersection of intellectual property and private international law: notwithstanding a high level of copyright harmonisation at the international level, there are still significant differences among the copyright regimes of individual countries that can result in a judgment of copyright infringement in one country being declared unenforceable in another country on the ground of repugnancy to public policy.
